* Implied trusts: Arising by operation of law

* Resulting trusts: Arising when property is transferred to a person who fails to fulfill the intended purpose

* Constructive trusts: Imposed by law to prevent unjust enrichment

Duties of Trustees

* Prudent management of trust property

* Keeping proper accounts

* Acting impartially

* Avoiding conflicts of interest

* Distributing trust income and corpus according to the trust terms

Rights of Beneficiaries

* Receive income and corpus from the trust

* Enforce their rights under the trust

* Hold trustees accountable for breach of duty

Termination of a Trust

A trust can be terminated by:

* Fulfillment of its purpose

* Agreement of all beneficiaries

* Court order

* Death of the last surviving trustee

Enforcement of Trusts
